This service is a way for groups of people of similar interests to be formed. Social events to be created by these groups. And people to attend and meet each other through these events. This service is provided by GOSOCIAL INC.

This is a contractual agreement between you and GOSOCIAL.COM. Please read this agreement carefully before registering. GOSOCIAL.COM is operated under the terms and conditions contained in this document. By completing the registration form and choosing "yes", you are indicating your agreement to be bound by all of the terms and conditions of this agreement for as long as you continue to be a member. If you do not agree to the terms, please do not register for this service.

Modifications to terms of service

GOSOCIAL.COM may change the terms and conditions of service from time to time. It is your responsibility to check this document periodically for any changes or modifications, as there will be no individual notice to members regarding such changes or modifications. Your continued use of the service constitutes an affirmative acknowledgment by you of the terms and conditions and any subsequent modifications made to them and your agreement to abide and be bound by them.

Member Obligations

Your membership is for your sole, personal use. You may not authorize others to use your membership, and you may not assign or otherwise transfer your account to any other person or entity. You are solely responsible for the content of information you publish or display ("post") on the service or transmit to other Members. You will not post or transmit to other Members or employees, any item that is defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive or illegal, or any material that infringes or violates another's rights (including but not limited to intellectual property rights and rights of privacy and publicity). GOSOCIAL.COM reserves the right, but has no obligation, to reject any profile it deems unacceptable.

You will not engage in any advertising to or solicitation of other Members to buy or sell any products or services through GOSOCIAL.COM

You will not be involved in transmitting any junk email or copyrighted material to other Members. Your usage of GOSOCIAL.COM must be in a manner consistent with all applicable state and federal laws and regulations in your area. You will not include in your profile any telephone numbers, street addresses, URLs, last names, or email addresses.

You will not include in your profile any photos containing children or child pornography of any kind. GOSOCIAL.COM reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions. You will not include in your profile any photos that are depicting any type of sexual act or photos that would be considered porn or violate GOSOCIAL.COM photo posting rules.

If a photo has been posted in error or intentionally by any system operator or employee, GOSOCIAL.COM reserves the right for its supervisors, to remove such photo or photos in question at any time that they feel the photos do not follow the photo posting rules of this contract, of course the reason will be justified if this becomes necessary, however GOSOCIAL.COM is under no obligation to provide such justification.

You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.

You are solely responsible for your interactions with other GOSOCIAL.COM Members. GOSOCIAL.COM reserves the right, but has no obligation, to monitor and/or mediate disputes between you and other members. Your usage of GOSOCIAL.COM must be in a manner consistent with all applicable state and federal laws and regulations.

Members may not interfere with another Member's use and enjoyment of the Service or another entity's use and enjoyment of similar services. GOSOCIAL.COM may, at its sole discretion, immediately terminate Service should Member's conduct fail to conform with these Terms and Conditions. GOSOCIAL.COM reserves the right to terminate any inactive or expired account.

Indemnity by members

You agree to defend, indemnify and hold harmless GOSOCIAL.COM , its officers, directors, employees, agents and third parties, from any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use and activities while using the GOSOCIAL.COM service, including any breach by you on the terms of this Agreement.

Information

All profiles must contain a valid email address. This address is only visible to the system operator. Your email address is the only way we have to contact you should there be a problem with your account or you lose your user name and password. Failure on your part to provide a valid email address may cause your profile to be removed.

Termination of membership

Either party may terminate this Agreement and your membership at any time for any reason, effective upon sending written notice to the other party. GOSOCIAL.COM reserves the right to immediately suspend or terminate your access to the GOSOCIAL.COM service, without notice, upon your breach of any of the terms of this Agreement.

Confidentiality of information

GOSOCIAL.COM will keep confidential all information supplied by you to GOSOCIAL.COM including credit card numbers, and shall use or disclose such information only for the purpose for which such information was collected, or as required by law.

In the case of GOSOCIAL.COM members who have signed and agreed to add their information and photo to be "Featured Members", these members have agreed to allow their basic information to be used for the Home Page of GOSOCIAL.COM's "Featured Members". They also agree to allow that same information to be used in any advertising whether in email, print or other media for distribution to prospective members and current members. In these cases, no member's home address, including city or state, outside email address, real name or phone number will be published in that advertising or marketing event.

Online content

Opinions, advice, statements, offers, or other information or content made available through GOSOCIAL.COM, are those of their respective authors and not that of GOSOCIAL.COM, and should not necessarily be relied upon. Such authors are solely responsible for such content. GOSOCIAL.COM does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, offer, advice, or statement made by parties other than GOSOCIAL.COM. Under no circumstances will GOSOCIAL.COM be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on GOSOCIAL.COM, or transmitted to GOSOCIAL.COM Members.

Proprietary interests and rights
GOSOCIAL.COM owns and retains other proprietary rights in the GOSOCIAL.COM service. The Service contains the copyrighted material, trademarks, and other proprietary information of GOSOCIAL.COM, its licensors and licensees. In addition, other Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

Disclaimer of Warranty

GOSOCIAL.COM provides the GOSOCIAL.COM service on an "as is" basis and grants no warranties of any kind, express, implied or statutory, in any communication with GOSOCIAL.COM or its representatives or otherwise with respect to the service. GOSOCIAL.COM specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. GOSOCIAL.COM does not warrant that your use of this service will be secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the service will be corrected. GOSOCIAL.COM disclaims liability for, and no warranty is made with respect to connectivity and availability.

Limitation of liability

In no event will GOSOCIAL.COM be liable to you for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of data, loss of photos, loss of programs, cost of procurement of substitute service or service interruptions) arising out of the use of or inability to use the GOSOCIAL.COM service, even if GOSOCIAL.COM or its agents or representatives know or have been advised of the possibility of such damages, or to any person other than you. Not withstanding anything to the contrary contained herein, GOSOCIAL.COM liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to GOSOCIAL.COM for the service during the term of membership.

GOSOCIAL.COM does not screen the members registering to the GOSOCIAL.COM service in any way, as a result, GOSOCIAL.COM will not be liable for any damages, direct, indirect, incidental and/or consequential, arising out of the use of this service, including, without limitation, to damages arising out of communicating and/or meeting with other Members of this service, or introduced to you via this service. Such damages include, without limitation, physical damages, bodily injury and or emotional distress and discomfort.

Advertising

By using this service or signing up for this service you agree to allow GOSOCIAL.COM to submit email messages to you regarding special promotional offers and other information pertaining to your account. This will not be considered to be unsolicited email because you are using this service. If you do not wish to receive such email messages then it will be up to you to either request that your account be removed or remove you own account.

Advertising in public areas by users

Anyone found to advertise via a picture posting or from within your profile or mail message will be removed from this system without refund for time paid. This includes but is not limited to trying to solicit other GOSOCIAL.COM Members to another web site using the GOSOCIAL.COM mail system or sending derogatory or misleading information about GOSOCIAL.COM to other Members of the GOSOCIAL.COM service.

Copyrights and copyright agents

By posting information or content to any public area of GOSOCIAL.COM, you automatically grant, and you represent and warrant that you have the right to grant, to GOSOCIAL.COM and other GOSOCIAL.COM Members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing.

Warning

It is possible that other GOSOCIAL.COM Members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on service and that you may be involuntarily exposed to such offensive and obscene materials. It also is remotely possible for others to obtain personal information about you due to your use of the Service, and that the recipient may use such information to harass or injure you. GOSOCIAL.COM is not responsible for the use of any personal information that you disclose on the Service. Please carefully select the type of information that you post on this service or release to others.

GOSOCIAL.COM reserves the right, but has no obligation, to monitor the materials posted in the public areas. GOSOCIAL.COM shall have the right to remove any such material that in its sole opinion violates, or is alleged to violate, the law or this Agreement. You remain solely responsible for the content of the materials you post in the public areas of the service and in your private e-mail messages. GOSOCIAL.COM will treat e-mails sent between you and other GOSOCIAL.COM Members that are not readily accessible to the general public as private to the extent required by applicable law. Private content may be reviewed by GOSOCIAL.COM if cause has been established for such an action, based on reports or suspicion of violation of terms and conditions of this agreement.

Notice

Any threat against GOSOCIAL.COM, or any other system owned and operated by GOSOCIAL INC. or it's personnel, employee's, or it's members made via email on the system or via regular email or through any other media source will cause immediate removal of your account without possibility of refund at the discretion of GOSOCIAL.COM.

You will defend, indemnify, and hold harmless GOSOCIAL.COM, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of any pictures posted to our web site that do not follow our rules stated on our photo rules page. Further GOSOCIAL.COM is not obligated to remove such material at your discretion.

In the event it becomes necessary for GOSOCIAL.COM to remove your account, you will defend, indemnify, and hold harmless GOSOCIAL.COM, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to your account information, mail messages and any other information or pictures posted to this web site.

This is a legal binding contract between you and GOSOCIAL.COM. If any part of this contract fails or is found to be flawed for any reason then only that part of this contract can be found to be null and void, however the remaining parts of this contract will remain in full force.

Should it be determined that you are in violation of any rules posted or implied then your account may be removed at the discretion of GOSOCIAL.COM.

Free trial memberships are offered to all new members of the web site. In the event that your free trial membership is removed for any reason you agree to hold harmless GOSOCIAL.COM, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to your account or information. As a trial member of this service you may not be able to access material or certain areas of GOSOCIAL.COM. This is subject to change at the discretion of GOSOCIAL.COM. You as a trial member are granted use of this system; however, GOSOCIAL.COM is not liable to you to provide this service nor is there any implied or written guarantee that this trial membership will continue indefinitely. GOSOCIAL.COM its officers, directors, employees, agents and third parties have granted you use of this system for your trial membership, however it will always be at the discretion of GOSOCIAL.COM to remove your account for any reason.

Termination

GOSOCIAL.COM reserves the right to remove your account at anytime for any reason at its own discretion, if this becomes necessary, the reason for removal will be justified. However, GOSOCIAL.COM is under no obligation to provide such justification. If your account was removed in error or by software or hardware failure GOSOCIAL.COM will make every effort to get you setup with a new account as soon as possible; however you will agree to hold harmless GOSOCIAL.COM, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to such account.

Violation

Having multiple accounts on this system is prohibited. Anyone found creating new account after trial accounts have expired will have all accounts removed and be blocked from using this system again. Upon login to this Web Site your IP address will be stored in our database as well as other relevant information so you can be identified as a valid user of this system.

Spamming Policy

Any Spamming of people on this Web Site will result in immediate removal of your account without any refund and you will be blocked from future use of the site.

Refunds

GOSOCIAL.COM does not offer refunds for unused time or for any reason. Because a free trial period is offered, GOSOCIAL.COM does not issue any refund or any paid or unused time for any reason.

Account Removal

GOSOCIAL.COM is not required to remove your imformation upon request. You may remove your own account by clicking "Remove Account" on the "Account" page on the web site.
